If you skirmish and don't shoot (either because you can't or don't choose to) - do you suffer the +1 factor your opponent gets for hitting shooty Cv on impact?
I am not sure you can choose not to shoot when skirmishing (or running away) - the description of the action is all about shooting and withdrawing. Certainly if you skirmish away from a flank/rear charge you are considered to have made a shooting action even though you don't actually shoot (which also answers the factor question for them).
A skirmish action is to shoot to the best of abilities and circumstances.
If there is no valid target at the outset the reality is they are turning around to face and shooting but consider the damage to be minor. The benefit being to turn.
